Power of Attorney for clients in Austria
In short

A power of attorney for India signed in Austria is executed before an Austrian notary and then apostilled, usually by the president of the competent regional court for notarial documents. Because the apostille is in force between India and Austria, no embassy attestation is needed. In India the original must be stamped within three months of arrival, and powers to sell property may need registration under the state's rules. We draft it in English to suit the Indian office that will use it.

Power of Attorney from Austria: how it works

We ask what the attorney holder must do and where: sell a flat in Kochi, manage rented property in Chandigarh or defend a case in Delhi, for instance. A special power limited to that task is usually accepted more easily than a general power. You sign before the Notar with your passport. Photographs and thumb impressions are added if the Indian sub-registrar expects them. The notarised document then goes for the apostille, and you send the original by courier while emailing us a scan.

In India we arrange adjudication and stamp duty under the state stamp law, and registration of the power where the state requires it. Sub-registrars check that names and addresses match your title documents and passport; differences between your Austrian passport name and Indian records cause most delays. If you have changed your name or nationality, include those details in the power. Once the work is done, the power should be revoked in writing so it cannot be misused later.

What clients in Austria should know

  • If you have become an Austrian citizen, sign as an Austrian national holding an OCI card and include your former Indian passport number for continuity.
  • The Embassy of India in Vienna can attest a power of attorney if an Indian bank insists on consular attestation instead of an apostille.
  • Austrian notaries may add their certificate in German; that is acceptable, but the main text of the power should be in English.

Questions from clients in Austria

Which apostille office do I use?

For a power signed before an Austrian notary, the apostille is normally issued by the president of the competent regional court. Your notary will confirm the office.

Can I sign the power digitally?

Not for property transactions in India. A wet-ink signature before the notary is needed.

Can my attorney holder sell agricultural land?

An attorney can act for you in selling land you already own, subject to state law. As an OCI holder you cannot buy agricultural land, but you can sell inherited land.
