People in Canada can manage Indian legal matters remotely. Since Canada joined the Apostille Convention in January 2024, documents signed before a Canadian notary or lawyer are apostilled by Global Affairs Canada or, for Alberta, British Columbia, Ontario, Quebec and Saskatchewan, by the provincial authority. The original is sent to India and stamped within three months. Canadian judgments are not directly executable in India, because Canada is not a reciprocating territory.
- Document route
- Notary or lawyer, then apostille from Global Affairs Canada or the provincial authority
- Time difference
- IST is 9h30 (Ontario, summer) to 13h30 (British Columbia, winter) ahead
- Foreign judgments in India
- Not reciprocating: fresh suit
- Apostille with India
- In force since January 2024
Indo-Canadian families and the problems we see
Canada's Indian-origin population is concentrated in the Greater Toronto Area, especially Brampton and Mississauga, in Surrey and the Lower Mainland of British Columbia, and in Calgary, Edmonton and Winnipeg. Many families emigrated from Doaba and Malwa in Punjab, with substantial communities from Gujarat, Haryana and the south as well. A large student population has added a younger generation who still hold Indian passports.
The most frequent matters from Canada concern land: a cousin or tenant farming ancestral land who stops paying and claims ownership, or a caretaker who will not leave the house. These are handled under illegal possession recovery and partition. We also defend NRIs against criminal complaints filed in India, handle divorces, and help clients bring money out of India lawfully. Being based in Mohali means our team can attend tehsils, police stations and courts across Punjab without delay.
Signing documents in Canada for use in India
Before January 2024, Canadians had to have documents authenticated by Global Affairs Canada and then legalised at the Indian High Commission or a consulate. Canada's accession to the Hague Apostille Convention replaced that two-step process with a single apostille.
| Where the document was notarised | Who issues the apostille |
|---|---|
| Alberta, British Columbia, Ontario, Quebec, Saskatchewan | The provincial competent authority |
| Other provinces and the territories | Global Affairs Canada (Authentication Services) |
| Federal documents | Global Affairs Canada |
In most provinces a lawyer acts as notary; in British Columbia notaries public are a separate profession, and in Quebec civil-law notaries perform the role. Sign with your passport, keep the signature consistent with your Indian records, and send the apostilled original to India, where stamping must follow within three months. Our power of attorney page covers drafting in detail.
Most requested services from Canada
These six services make up most of our work for clients in Canada. Each page explains how the matter is run from Canada, from the Canadian apostille through to the Punjab or other Indian court or office.
Encroachment & Illegal Possession
Land and houses left in Punjab are often occupied by tenants, caretakers or relatives who refuse to leave.
Partition of Family Property
Ancestral land shared among siblings in India and Canada needs a legal partition before anyone can sell or develop it.
Power of Attorney
An apostilled Canadian power of attorney lets a trusted person act at tehsils, banks and courts in India.
Criminal Defence & Look Out Circulars
NRIs in Canada are sometimes named in matrimonial or fraud complaints in India and need protection before travelling.
Divorce for NRIs
A Canadian decree may not end an Indian marriage in India, so many couples divorce in an Indian court.
Repatriation of Funds
Sale proceeds and inheritances held in NRO accounts need the right forms to reach a Canadian bank.
Canadian tax, the treaty and getting money out of India
India and Canada have a tax treaty that allows credit in Canada for Indian tax on Indian income. Canadian residents are taxed on worldwide income, so Indian rent and gains also appear on the Canadian return, and specified foreign property costing more than CAD 100,000 in total is reported to the CRA on Form T1135.
Many clients hold sale proceeds or inherited money in NRO accounts. These can be repatriated up to USD 1 million per financial year with Forms 15CA and 15CB, after Indian tax is paid. Our guide to repatriation of funds explains the paperwork, including how to show the source of an inheritance to the bank.
Canadian orders, divorce and criminal complaints
Canada is not a notified reciprocating territory, so an Ontario or BC judgment is enforced in India only by a fresh suit, and the defendant can resist it on the section 13 CPC grounds. Canadian divorces raise the recognition problem set out by the Supreme Court in Narasimha Rao: a decree on a ground not available under the Hindu Marriage Act, granted against a spouse who did not submit to the Canadian court, may not be recognised in India.
Matrimonial disputes also produce criminal complaints in India, usually of cruelty under section 85 of the Bharatiya Nyaya Sanhita 2023 (formerly section 498A IPC). An NRI named in such a complaint can face a Look Out Circular or passport proceedings. Anticipatory bail under section 482 BNSS (formerly section 438 CrPC) can often be sought through counsel before you travel, and many High Courts have quashed complaints that are vague against relatives abroad.
Working with us from Canada
India is nine and a half hours ahead of Toronto in summer and ten and a half in winter, and twelve and a half to thirteen and a half hours ahead of Vancouver. Evening calls in Ontario fall early in the Indian morning, which suits us. We send hearing updates the same Indian day so they reach you by your morning.
Courier from Canada to Punjab usually takes a week. Revenue courts and tehsils often want originals, so we keep certified copies of jamabandi, mutation and fard records on file and share scans immediately. Punjab also has a State Commission for NRIs and dedicated NRI police units, which can help in some property and fraud matters alongside court proceedings.
Students and temporary workers in Canada who still hold Indian passports follow the same document route, but should keep their Indian address and PAN details current, because banks and registrars match names closely. Where you need to visit India, we try to cluster the steps that need you personally, such as biometric registration or a court statement, into a single trip.

Frequently asked questions
Do I still need the Indian High Commission to legalise my documents?
Generally no. Since January 2024 an apostille from the competent Canadian authority replaces consular legalisation for documents going to India.
Who notarises documents in Canada?
A lawyer acting as notary in most provinces, a notary public in British Columbia, or a civil-law notary in Quebec. The apostille then comes from the province or Global Affairs Canada.
Can an Ontario court judgment be enforced in India?
Only by filing a fresh suit in India based on the judgment, because Canada is not a reciprocating territory. The debtor can raise the defences in section 13 CPC.
Someone is occupying my land in Punjab. Do I need to come to India?
Usually not at the start. Your attorney holder can file the civil suit and police complaint, and your evidence can often be recorded by video or commission.
Is my Canadian divorce valid in India?
It may be if both spouses took part and the ground matches Indian law. A decree obtained against an absent spouse on a ground unknown to Indian law is open to challenge.
A complaint has been filed against me in India. Is it safe to travel?
Check first. We can find out whether an FIR, warrant or Look Out Circular exists and seek anticipatory bail before you book a flight.
Can Canadian citizens inherit agricultural land in Punjab?
Yes, inheritance is permitted, although OCI cardholders and foreign citizens cannot buy agricultural land. Selling it later is subject to FEMA and stamp rules.
Do I report Indian property to the CRA?
Indian property held for investment, together with other specified foreign property, must be reported on Form T1135 if the total cost exceeds CAD 100,000. Personal-use property is treated differently, so ask your Canadian accountant.
