Co-owners in the UK can partition Indian ancestral or inherited property by a registered partition or family settlement deed if everyone agrees, or by a civil suit or revenue proceedings if not. Daughters have equal coparcenary rights following the 2005 amendment and Vineeta Sharma (2020). UK-based co-owners sign through notarised, FCDO-apostilled documents, and courts can record their evidence by video.

Partition of Family Property from the UK: how it works
We trace ownership from the original holder and identify all current co-sharers, including those in the UK who may not know they have a share. Where agreement is possible, we draft a partition or settlement deed allocating specific portions, which UK co-owners sign before a notary and apostille. Stamp duty on registration depends on the state and the structure, and planning can reduce it.
If a co-owner in India refuses, we file a partition suit, or a revenue partition for agricultural land, seeking a preliminary decree of shares and then division by metes and bounds or sale. We also ask for accounts of income from the land and an injunction against alienation. Long-pending partitions can be shortened by mediation, which many courts encourage and which can be done by video between India and the UK.
What clients in the UK should know
- A relinquishment deed signed by a UK co-owner in favour of a relative in India should be considered carefully for UK and Indian tax consequences.
- Agricultural land cannot be bought by British citizens holding OCI cards, but they can receive it in partition of inherited land.
- Earlier oral family arrangements may bind later generations if acted upon, so collect any evidence of how the land has actually been divided.

Questions from clients in the UK
Can I demand partition while living in the UK?
Yes. A co-owner can sue for partition through an attorney holder and give evidence by video.
Do I get a share if my father was born in India but I was born in the UK?
Your rights depend on the law of succession applicable to your family and whether the property is ancestral. Being born abroad does not by itself exclude you.
Can we sell instead of dividing the land?
Yes, by agreement or, where division is impractical, by court order for sale with proceeds shared.
