People living in Kuwait can get most Indian legal work done without travelling. Kuwait is not party to the Apostille Convention, so a document signed there is authenticated by the Kuwaiti Ministry of Justice or a notary, attested by the Kuwait Ministry of Foreign Affairs and then attested by the Embassy of India in Kuwait; Indian nationals can also sign before the Embassy's consular officer. Kuwaiti judgments are not executable under section 44A, so claims are brought afresh in India.
- Document route
- Kuwaiti Ministry of Justice notarisation, Kuwait Ministry of Foreign Affairs attestation, then Embassy of India attestation
- Time difference
- IST is 2h30 ahead of Kuwait time all year (no daylight saving)
- Foreign judgments in India
- Not reciprocating: fresh suit
- Apostille with India
- Not in force: consular attestation
Indian families in Kuwait and their ties to home
The Indian community is the largest foreign group in Kuwait. It includes nurses and doctors in Kuwaiti hospitals, engineers in the oil sector around Ahmadi, teachers, shopkeepers, domestic workers and drivers, with large numbers from Kerala, Andhra Pradesh, Tamil Nadu, Goa and Gujarat. Because Kuwait offers no route to permanent settlement for most expatriates, nearly every family plans an eventual return to India and invests accordingly.
The legal questions we receive reflect that. Clients ask for help with recovering money lent in India, tenants who will not leave a house built with Kuwaiti savings, succession certificates and mutation after a parent's death, and powers of attorney so that a sibling can act for them. A large share of our Kuwait work is simply getting documents attested correctly so that an Indian office accepts them.
Attestation in Kuwait, step by step
Kuwait has not joined the Hague Apostille Convention, so documents travelling between Kuwait and India go through consular attestation.
- Authentication in Kuwait. A private document such as a power of attorney or affidavit is authenticated at a Ministry of Justice notarisation office. An Arabic translation by a certified translator may be required.
- Kuwait Ministry of Foreign Affairs. The ministry's attestation section confirms the Ministry of Justice seal.
- Embassy of India, Kuwait. The Embassy attests the foreign ministry's seal. Indian citizens may instead sign directly before the Embassy's consular officer, generally through its outsourced service centres, which avoids the Kuwaiti steps.
The same principle applies in reverse. Indian documents needed in Kuwait, such as degree certificates, birth certificates or a court decree, are attested in India by the state authority and the Ministry of External Affairs and then by the Embassy of Kuwait in New Delhi. Our page on apostille and attestation sets out both directions.
Most requested services from Kuwait
These six services are the ones Kuwait residents ask us for most. Each page explains the Kuwaiti attestation chain alongside the steps taken in Indian courts and offices.
Money Recovery from India
Savings lent from Kuwait to relatives and friends in India are often left unpaid once the lender is far away.
Tenant Eviction
Houses built with Kuwaiti earnings are frequently let out, and some tenants stop paying or refuse to leave.
Succession Certificate
Heirs in Kuwait need a court certificate to collect a parent's deposits, shares and other debts in India.
Mutation & Transfer
Inherited land must be recorded in the heirs' names in village or municipal records before it can be sold or protected.
Power of Attorney
A power attested through the Kuwaiti ministries or the Embassy lets a trusted person act in India while you work.
Apostille & Attestation
Because Kuwait has no apostille, documents in both directions need consular attestation, and errors are common.
Tax and remittances between Kuwait and India
Kuwait does not tax individual salaries, but Indian income remains taxable in India. Rent from an Indian house, NRO interest and capital gains on Indian land are all within the Indian tax net, and tenants or buyers paying a non-resident may need to deduct tax at source. India and Kuwait have a comprehensive tax treaty, and a certificate of tax residence from the Kuwaiti Ministry of Finance helps when claiming treaty rates on interest or dividends.
Money sent from Kuwait through banks and exchange companies to NRE accounts is fully repatriable. NRO funds, including rent and inheritance, can be repatriated up to USD 1 million per financial year with Forms 15CA and 15CB. Keep exchange company receipts for loans made to relatives in India; they are often the best evidence if the money has to be recovered later.
Kuwaiti judgments, family orders and Indian courts
Kuwait is not a reciprocating territory under section 44A CPC, so a money judgment from a Kuwaiti court cannot be executed in India as it stands. A creditor sues in India on the judgment or on the original debt, and the Indian court examines the Kuwaiti judgment under section 13 for jurisdiction, merits, natural justice and fraud. Kuwait and India are both parties to the New York Convention, which allows arbitral awards to be enforced in India.
Kuwaiti personal status law is based on Islamic law, and most non-Muslim Indian families resolve divorce, custody and inheritance in India. For inheritance, Indian property passes under Indian succession law, whichever country the deceased lived in. A family member in Kuwait can still apply for a succession certificate and update land records without travelling.
Practical points for clients in Kuwait
Kuwait stays on the same time all year, two and a half hours behind India. An 8 pm call in Kuwait City is 10.30 pm in Mohali, so we often meet clients on Saturday mornings or early evenings. Courier between Kuwait and South Indian cities typically takes three to five days.
Before travelling to India, check whether any case, cheque complaint or tax demand is pending, and in Kuwait, whether any civil or travel ban may affect your departure or return. Most Indian courts now permit video appearance, and evidence can often be recorded remotely, so travel is needed only for a few steps such as a property registration where you prefer to sign yourself.

Frequently asked questions
Is there an apostille in Kuwait for documents going to India?
No. Kuwait is not a party to the Apostille Convention. Documents are authenticated by the Kuwaiti Ministry of Justice, attested by the Kuwait Ministry of Foreign Affairs and then by the Embassy of India, or signed before the Embassy's consular officer.
Can a Kuwaiti court judgment be executed in India?
Not directly. Kuwait is not notified under section 44A, so a creditor files a suit in India and relies on the judgment, which the court tests under section 13.
I lent money to a relative in India from Kuwait. Can I recover it?
Yes, if you can prove the loan and act within limitation. Bank and exchange company records, messages and any cheque or written acknowledgment are the key evidence.
Do I pay Indian tax on rent while I live in Kuwait?
Yes. Rent from Indian property is taxable in India, and a tenant may have to deduct tax at source. Kuwait's lack of income tax does not change this.
What is the time difference between Kuwait and India?
India is two and a half hours ahead of Kuwait throughout the year, as neither country uses daylight saving.
How do I attest an Indian court order for use in Kuwait?
The certified copy is attested by the relevant Indian authority and the Ministry of External Affairs, then by the Embassy of Kuwait in New Delhi, and finally by the Kuwait Ministry of Foreign Affairs after it arrives.
Can my wife, who is not an Indian citizen, sign at the Indian Embassy in Kuwait?
Consular signing is mainly for Indian nationals. A foreign national generally signs before the Kuwaiti Ministry of Justice and follows the foreign ministry and Embassy attestation chain.
Do I need to travel to India for an eviction or recovery case?
Usually not. Your lawyer appears on routine dates and evidence can often be recorded by video. Some courts may require attendance for specific steps.
