Tenant Eviction for clients in the UAE

Many UAE-based Indians rent out a flat or house at home for extra income and find enforcement difficult when a tenant stops paying or refuses to leave.

Tenant Eviction for clients in the UAE
In short

A UAE-based landlord can evict a tenant in India through the rent controller or civil court under the state's rent law. Punjab and Chandigarh law, among others, gives an NRI owner a quicker remedy where the house is genuinely needed for the owner's own use. You appoint an attorney holder through a power of attorney attested in the UAE, and we conduct the case.

Tenant Eviction from the UAE: how it works

We check the rent agreement, its registration and the payment record, and identify the governing law. A legal notice terminates the tenancy and demands arrears. In Punjab and Chandigarh, section 13-B of the rent law allows an eligible NRI owner to seek eviction for own use by a summary procedure, once. Kerala, Delhi, Maharashtra and other states have their own rules and grounds, such as arrears, subletting or damage, and states adopting the Model Tenancy Act have set up rent authorities with shorter timelines.

The eviction petition is filed with ownership and tenancy evidence, and courts commonly direct the tenant to deposit arrears and continue paying rent into court, which often brings a settlement. If contested, evidence is led, with your affidavit and video testimony where permitted. After the order, we pursue execution. We also draft a new, registered agreement and a police verification for future tenants, which avoids most problems.

What clients in the UAE should know

  • Rental income from India is taxed in India; the UAE does not tax personal income, so there is no foreign tax credit question there.
  • A tenant paying rent to a non-resident landlord must deduct tax at source; ask for TDS certificates each year.
  • Police verification of tenants is required in many Indian cities and helps if the tenant later disappears with arrears.
