Indian lawyers for clients in Italy

Legal work in India for the Indian community in Italy

Many Indians in Italy come from Punjab and work in farming, dairy and industry from Latina to Lombardy. Their legal needs in India are mostly about land, family and protecting their position while abroad, and we handle them from Mohali.

In short

Someone living in Italy can deal with most Indian legal problems without returning. A power of attorney is signed before an Italian notaio, or before a consular officer at the Indian Embassy in Rome or the Consulate General in Milan, and Italian notarial documents are apostilled by the Procura della Repubblica. The document is couriered to India, stamped, and used by a trusted relative and your lawyer to file cases, deal with revenue offices and protect your land.

Who we help in Italy, and with what

Italy has one of Europe's largest Indian communities, a large share of it Punjabi and Sikh. Families live in the Agro Pontino around Latina, in the dairy and farming districts of Lombardy around Cremona, Brescia and Mantua, and in Emilia-Romagna and Veneto. Many came from the Doaba districts of Jalandhar, Hoshiarpur, Kapurthala and Nawanshahr, and still own agricultural land or houses there. Indian professionals and students are also present in Milan and Rome, and Italian machinery and fashion companies do business with India.

The matters we see from Italy reflect that history. Land and houses left in Punjab are occupied by tenants, relatives or neighbours; brothers disagree about dividing the family share; marriages arranged in India need registration for Italian papers; and some marriages break down across two countries. For land problems, see illegal possession recovery and partition of family property.

How documents are signed and legalised in Italy

Italy and India are both parties to the Apostille Convention, and it applies between them. A private document for India, such as a power of attorney (procura), is signed before an Italian notaio, who authenticates the signature. For notarial and judicial documents, the apostille is issued by the Procura della Repubblica at the Tribunale for the area, while administrative documents are generally apostilled by the Prefettura.

Many Punjabi clients find it easier to sign before a consular officer at the Embassy of India in Rome or the Consulate General of India in Milan, which provide attestation services for Indian nationals and OCI holders. Either route is accepted in India. The document should be in English, or bilingual Italian and English, because a document only in Italian needs a translation before Indian offices will act on it.

Most requested services from Italy

These six services make up most of what the Indian community in Italy asks us for, most of it rooted in family land and marriages in Punjab.

Tax treaty and money flows between Italy and India

India and Italy have a double taxation avoidance agreement. If you live in Italy and earn rent from a house in Punjab, interest on an NRO account or a gain on selling land, India usually taxes that income first, and Italy gives relief for Indian tax under the treaty and its own rules. Treaty benefits in India need an Italian tax residence certificate and Form 10F.

Money from selling Indian property comes out through your NRO account, up to USD 1 million per financial year, with Form 15CA and 15CB. Sale proceeds of agricultural land and inherited assets need careful documentation. Italian residents should also keep their Italian adviser informed, as Italy expects foreign assets and income to be reported. Our NRI income tax page explains the Indian filing.

Family law and Italian court orders in India

Italy is not a reciprocating territory under section 44A of the Code of Civil Procedure, so an Italian judgment for money cannot be executed directly in India. A fresh suit is needed, with the Italian decision tested under section 13. In family cases, an Italian divorce for a couple married in Punjab under the Hindu Marriage Act or Anand Marriage Act is recognised in India only if the ground is one available under that law and the spouse in India took part or consented.

Disputes between spouses in Italy and India often involve criminal complaints in India, maintenance claims and custody of children. India is not a party to the Hague Child Abduction Convention, so Italian custody orders are considered but not automatically enforced. Look Out Circulars and complaints of cruelty or dowry can affect travel plans, and early legal advice matters. See criminal defence for NRIs.

Practical points for clients in Italy

Italy uses Central European Time, so India is three and a half hours ahead in summer and four and a half in winter. Many of our Italian clients work early shifts on farms and in dairies, so we often hold calls in the Italian evening, when it is late night in India, by prior arrangement, or on Sundays. We can speak in Punjabi and Hindi as well as English.

A permesso di soggiorno renewal or an Italian citizenship application can be disrupted by long, unplanned stays in India, so we try to keep Indian court appearances to a minimum through powers of attorney and video evidence. Send originals by tracked courier and keep photographs of every page, including stamps and the apostille.

Frequently asked questions

Where do I get an apostille in Italy for an Indian document?

For a document signed before a notaio, the apostille comes from the Procura della Repubblica at the local Tribunale. Administrative documents are usually apostilled by the Prefettura.

Can I sign my power of attorney at the Indian Consulate in Milan?

Yes, the Embassy in Rome and the Consulate General in Milan provide attestation services. Check their current appointment process and fees before you go.

Can my brother in Punjab take my land while I am in Italy?

Not lawfully. Your share remains yours, and we can protect it through revenue records, notices, an injunction and, if needed, a partition or possession suit filed through your attorney holder.

Is an Italian divorce valid in India?

Only if it meets the tests set by the Supreme Court, including a ground available under the law of your marriage and participation or consent by the other spouse. Otherwise a fresh Indian divorce may be needed.

Do I have to travel to India for a court case?

Often not. Your lawyer and attorney holder handle routine dates, and many courts allow evidence by video link. Some criminal and matrimonial steps require personal appearance.

Will a case in India affect my Italian residence permit?

A case does not directly affect your permit, but an arrest, passport impounding or Look Out Circular could stop you returning in time. Plan any travel with legal advice.

Does India's tax treaty with Italy help on rent from my Punjab house?

Yes. India taxes the rent and Italy gives relief for the Indian tax. You need an Italian tax residence certificate and Form 10F to claim treaty benefits in India.

Does ProudLegal have an office in Italy?

No. We are based in Mohali, Punjab, and serve clients in Italy by video call, WhatsApp and email, in Punjabi, Hindi or English.
