Mutation & Transfer for clients in the UAE

When a father who built the family house with Gulf earnings passes away, the land record in India often stays in his name while the children are working in Dubai or Abu Dhabi.

Mutation & Transfer for clients in the UAE
In short

Mutation is the entry in the land or municipal register that shows the heirs as the new owners after a death, gift or purchase. From the UAE, heirs sign affidavits or a power of attorney, which are notarised, attested by the UAE Ministry of Foreign Affairs and then by the Indian Embassy or Consulate. We file in India, attend the hearing and obtain the updated record.

Mutation & Transfer from the UAE: how it works

We list the documents needed for your state: the death certificate, a legal heir certificate or family tree, identity proof for each heir and consents or relinquishment deeds where some heirs give up their share. Heirs living in the UAE sign together where possible to save on attestation costs, and those in India sign locally. Where the deceased left a will, the revenue office may ask for it and sometimes for probate, depending on the state.

In India, the revenue officer or municipal authority issues notice, hears objections and sanctions mutation. Our team attends and responds to queries. If a relative objects on title grounds, the officer may refer the matter to the civil court, and we advise you on that route. After mutation, we obtain the updated record and help you keep property tax current from the UAE so that no arrears build up.

What clients in the UAE should know

  • Attesting each heir's affidavit separately in the UAE costs time and fees; signing a joint document where the law allows reduces both.
  • Inheritance is not taxed in India, and the UAE has no personal income tax, but a later sale of the property is taxed in India.
  • Delay in mutation multiplies the number of heirs over time and makes the process harder.

Questions from clients in the UAE

Can mutation be done while all heirs are in the UAE?

Yes. They sign in the UAE through the attestation chain and we handle everything in India.

How long does it take?

Typically one to four months after filing.

Does mutation make me the legal owner?

Ownership passes by inheritance or will; mutation records it in the revenue and municipal books.
