Property Disputes for clients in Canada

For the large Punjabi and Gujarati communities in Brampton, Surrey, Calgary and Montreal, a dispute over land or a house back in India is one of the most common legal worries.

Property Disputes for clients in Canada
In short

If you live in Canada and your property in India is under dispute, an Indian advocate can file and defend civil suits for you. Since January 2024 Canada is part of the Apostille Convention, so your vakalatnama and affidavits signed before a Canadian notary or lawyer only need an apostille from Global Affairs Canada or your provincial authority. You follow hearings by video and email, and travel only if the court insists.

Property Disputes from Canada: how it works

We review the title deeds, the revenue record and whatever relatives have told you, and schedule calls in the Canadian evening, which is the Indian morning. Many disputes reported by Canadian clients concern farmland in Punjab and Haryana where a relative has had the land mutated in their own name or leased it out. We obtain certified copies of the jamabandi and mutation history, check whether any sale deed has been registered, and decide whether to sue for declaration and possession, challenge a mutation, or both.

Documents for the court are signed in Canada. In Ontario, Alberta, British Columbia, Quebec and Saskatchewan, the provincial authority issues the apostille; elsewhere Global Affairs Canada does. Originals go to India by courier. Punjab has a dedicated NRI wing of the police and an NRI Commission, which can help where a dispute involves threats or forged documents, and we use them alongside the civil case. Interim injunctions protect the property while the suit proceeds.

What clients in Canada should know

  • Before 2024, Canadian documents needed authentication and consular attestation; that is no longer required, which saves Canadian clients weeks.
  • If you hold Indian property costing more than CAD 100,000 in total, the CRA expects it on Form T1135, and a dispute does not change that obligation.
  • A Canadian citizen with an OCI card keeps rights to inherited land, including agricultural land, though new agricultural purchases are barred.

Questions from clients in Canada

Who issues the apostille in Ontario?

Ontario's Official Documents Services issues apostilles for documents notarised in Ontario. Several other provinces have their own authority; the rest use Global Affairs Canada.

My cousin had my land mutated in his name. Can that be reversed?

Yes. A mutation can be challenged before the revenue authorities, and title is protected through a civil suit. We usually pursue both.

Can the Punjab NRI Commission decide my case?

It can look into complaints and push authorities to act, but title disputes are decided by civil courts.
