Indian lawyers for clients in Oman

Indian legal services for residents of Oman

Indian merchants have traded with Oman for centuries, and today Indian professionals, workers and business families live across the Sultanate. When they need to start a company, make a will, sell a flat or recover a debt in India, we do the Indian work from Mohali, and Oman's membership of the Apostille Convention keeps the paperwork short.

In short

Residents of Oman can handle most Indian legal work without travelling. Oman is a party to the Apostille Convention, so a document notarised in Oman is apostilled by the Omani Ministry of Foreign Affairs and accepted in India without embassy attestation; Indian nationals may also sign at the Embassy of India in Muscat. Omani court judgments cannot be executed under section 44A, so money claims are filed as fresh suits in India.

Old trading links and a modern Indian community

Kutchi, Sindhi and Gujarati merchant families settled in Muscat and Muttrah long before the oil era, and some have been in Oman for many generations. Alongside them, Keralites, Tamils, Maharashtrians and Punjabis work in construction, healthcare, education, engineering, ports and the free zones at Sohar, Duqm and Salalah. Many run their own businesses in Oman with suppliers, family members or factories in India.

That mix produces a distinctive caseload. Business owners in Muscat ask us about setting up a company in India as a sourcing or service arm. Older clients want an Indian will that deals cleanly with assets in both countries. Others are selling a flat in India and need to understand the tax the buyer must deduct, or are chasing a loan that a relative or trading partner in India has not repaid.

Notarising and apostilling documents in Oman

Oman joined the Hague Apostille Convention in 2011, and India has been a party since 2005, so the convention applies between them. A single apostille replaces the chain of ministry and embassy attestations used in neighbouring Gulf states.

  1. Notarise. Sign the affidavit or power of attorney before a notary public of the Ministry of Justice and Legal Affairs, carrying your passport and resident card. Arabic translations may be required for some documents.
  2. Apostille. The Omani Ministry of Foreign Affairs issues the apostille on the notarised document.
  3. Send to India. Courier the original, and make sure it is stamped in the relevant Indian state within three months of arrival.

Indian citizens can instead sign before the consular officer at the Embassy of India in Muscat, generally through its outsourced service centre. For company documents of an Omani parent, the board resolution and incorporation certificate are notarised and apostilled in Oman before filing with the Indian Registrar of Companies.

Most requested services from Oman

These are the six services Oman residents most often ask us for. Each page explains how the Omani apostille fits the Indian process and what can be done without leaving the Sultanate.

Tax, the India and Oman treaty, and moving funds

Oman has traditionally not taxed individual employment income, while Indian income stays taxable in India. Rent, interest, dividends and gains on Indian property and shares are taxed in India, and a buyer of property from a non-resident must deduct tax at source, often at a higher figure than the final liability. India and Oman have had a comprehensive tax treaty since 1997, and a tax residency certificate issued by the Oman Tax Authority supports treaty claims.

Our page on TDS on NRI property sales explains how to obtain a lower deduction certificate before you sell. NRO funds can be repatriated up to USD 1 million per financial year with Forms 15CA and 15CB, and investments in an Indian company by an Omani resident must be reported under FEMA.

Omani judgments, arbitration and family matters

Oman is not notified as a reciprocating territory under section 44A CPC. A judgment of an Omani court for a sum of money can only be used in India by filing a suit, in which the court applies the tests in section 13. For commercial disputes with Indian counterparties, arbitration is often a better choice, because both Oman and India are parties to the New York Convention and a foreign award can be enforced in India under Part II of the Arbitration and Conciliation Act.

Family and inheritance questions are usually settled under Indian law for Indian families. Indian immovable property passes under Indian succession law, and a will made in Oman can be valid in India if executed with two witnesses. Assets in Oman, such as bank balances and end-of-service gratuity, follow Omani procedure, so families should plan both sides with appropriate advice in each country.

Working with us from Oman

Oman does not observe daylight saving, so India is always one and a half hours ahead. A 7 pm call in Muscat is 8.30 pm in Mohali, and we also meet clients on Saturdays. Courier between Muscat and Indian cities usually takes three to five days, and flights to Kerala, Mumbai and Delhi are short, so some clients prefer to bring originals themselves.

Indian courts allow video appearance, and company filings, tax matters and most property work are done online or through an attorney holder. If a cheque case, tax demand or police complaint is pending against you in India, ask us to check before travelling, and if you have business debts in Oman, confirm that no travel ban has been imposed there before you leave.

Frequently asked questions

Can I get an apostille in Oman for a document used in India?

Yes. Oman is a party to the Apostille Convention, so a document notarised in Oman can be apostilled by the Omani Ministry of Foreign Affairs and used in India without embassy attestation.

Is an Omani court judgment enforceable in India?

Not by direct execution. Oman is not a reciprocating territory under section 44A, so you file a suit in India, relying on the judgment, which is tested under section 13 CPC.

Can I start an Indian company while living in Muscat?

Yes. A non-resident Indian, OCI cardholder or Omani company can incorporate an Indian private company, but at least one director must be resident in India for 182 days in the financial year.

Do I pay Indian tax when I sell my flat while living in Oman?

Yes. Capital gains on Indian property are taxable in India, and the buyer must deduct tax at source. The India-Oman treaty leaves gains on Indian immovable property taxable in India.

What is the time difference between Oman and India?

India is one hour thirty minutes ahead of Oman all year, as neither country changes its clocks.

Is a will signed in Muscat valid in India?

Yes, if it is in writing, signed by you and attested by two witnesses. Registration in India is optional, and probate may be needed in some cities.

Can I sign at the Indian Embassy instead of getting an apostille?

Yes, if you are an Indian national. Some clients prefer it for property powers of attorney, while foreign nationals use the notary and apostille route.

How long does the Omani apostille take?

Usually a few working days after notarisation, though timings vary. We send drafts early so the document is right before you visit the notary.
