Heirs living in Kuwait can have inherited or gifted property mutated into their names by applying to the village, tehsil or municipal office with the death certificate, proof of heirship and title documents. In Kerala the process is known as pokkuvaravu. Applications can be made by an attorney holder using a power attested at the Embassy of India in Kuwait or through the Kuwaiti ministries, and many states accept online applications.

Mutation & Transfer from Kuwait: how it works
We confirm how title passed: by succession, by a registered will, by a family settlement or by gift. Each needs different supporting papers, such as a legal heir certificate, probate where required, or the registered deed. We obtain current revenue extracts and tax receipts, then prepare the application and any consent affidavits from co-heirs. You sign a power of attorney in Kuwait so that a relative or our team can attend the village officer or municipal office and answer queries.
The revenue officer usually issues notice, may visit the property and then passes an order recording the new owners. Objections from relatives or neighbours turn the matter into a contested mutation, which can be appealed to higher revenue authorities. Mutation records possession and revenue liability; it does not itself decide title, so a disputed inheritance may still need a civil court decision. Once mutated, pay the land or property tax in the new names to keep the record consistent.
What clients in Kuwait should know
- Revenue offices in Kerala, Andhra Pradesh and Tamil Nadu increasingly accept applications online, but the original power of attorney attested in Kuwait may still be inspected.
- If co-heirs in Kuwait and India agree on who takes what, a registered family settlement before mutation avoids later disputes.
- Mutation is a prerequisite for most sales; a buyer's lawyer will check that the record shows the sellers, so finish it before you market the property.

Questions from clients in Kuwait
Can mutation be done without a succession certificate?
Usually yes. Revenue offices rely on a legal heir certificate or family membership certificate. A succession certificate is for bank deposits and securities, not land.
My uncle has objected to the mutation. What happens?
The officer will hear both sides. If the dispute is about title, the parties may be directed to the civil court.
How long does mutation take?
It varies by state and office, from a few weeks for an uncontested online application to several months where notice and inspection are needed.
