An Indonesian business can recover money from an Indian debtor by legal notice, arbitration if the contract provides it, a summary or commercial suit in an Indian court, or insolvency proceedings against a corporate debtor for defaults above the statutory threshold. Indonesian judgments cannot be executed directly in India. Commercial suits generally require pre-institution mediation first unless urgent relief is sought. Limitation is generally three years, so delay weakens the claim.

Money Recovery from India from Indonesia: how it works
We review the contract, letters of credit, bills of lading, inspection certificates, invoices, correspondence and any acknowledgment of the debt. We check the buyer's financial position and whether it is part of a larger group. A legal notice setting out the claim and the next steps often leads to settlement talks. If the contract has an arbitration clause, we start arbitration or, if the seat is outside India, coordinate with counsel at the seat while preparing enforcement in India. Otherwise we choose between a summary suit, where the claim rests on a written contract, and a regular commercial suit.
Where the debtor is a company and the default exceeds the insolvency threshold, an operational creditor's application under the Insolvency and Bankruptcy Code can be effective, but the debtor may defeat it by showing a pre-existing dispute, so evidence matters. Authority documents for the Indonesian company are notarised and apostilled, and witnesses can usually give evidence by video. Once a decree or award is obtained, we attach bank accounts and assets of the debtor and help remit the recovery to Indonesia through the bank, with tax documentation.
What clients in Indonesia should know
- Quality disputes based on discharge port analysis are common; the contract's clause on whose certificate is final often decides the case.
- Demurrage claims are recoverable as debts if the contract fixes the rate and laytime, and should be invoiced promptly.
- Interim orders in India, such as attachment before judgment, are available only on strong evidence that the debtor is disposing of assets.

Questions from clients in Indonesia
Can we use an Indonesian court judgment in India?
Only as the basis for a fresh suit in India, because Indonesia is not a reciprocating territory.
How long does recovery take in India?

Can recovered money be sent back to Indonesia?
Yes, through the bank with the court order or award, and Form 15CA and 15CB where required.
