A Malaysian heir can protect or recover Indian property through a civil suit for declaration of title, possession and injunction, or a partition suit against co-owners. We first trace the title through revenue and registration records, then send a legal notice, file in the civil court and seek interim orders to stop sale or construction. Documents are attested through Wisma Putra and the High Commission, and you can usually give evidence by video.

Property Disputes from Malaysia: how it works
We start by tracing the property. In Tamil Nadu, that means patta, chitta and adangal extracts, the encumbrance certificate from the sub-registrar and older registered deeds. We establish your descent from the recorded owner and identify who is in possession and on what claim. A site visit and photographs record the current state. Heirs in Malaysia sign a power of attorney and affidavits through the attestation chain so that a relative or our team can act in India.
We then send a legal notice and, if needed, file a suit for declaration, possession or partition, with an application for a temporary injunction to stop sale, construction or further encumbrance. Limitation is a key issue: a person in adverse possession for twelve years may claim title, so delay is dangerous. Courts often refer property disputes to mediation, and settlements can be recorded as decrees. If the land was sold using forged documents, we may also file a criminal complaint and seek cancellation of the deed.
What clients in Malaysia should know
- Revenue records in India may have been updated without the heirs' knowledge, so obtaining the latest patta and encumbrance certificate is the first step.
- Adverse possession claims based on twelve years of open, hostile occupation can defeat absent owners, so heirs should assert their rights as soon as they learn of an occupation.
- If the land is agricultural, Malaysian heirs can inherit it, but they cannot buy additional agricultural land without permission.

Questions from clients in Malaysia
Can I file a property case in India from Malaysia?
Yes, through a power of attorney holder or directly through your lawyer, with your affidavits attested through the Malaysian chain. Evidence can often be given by video.
A relative sold our ancestral land. What can we do?
If your share was sold without consent, you can sue for declaration, partition and cancellation of the sale deed. Act quickly to avoid limitation problems.
How long do property cases take?
Civil suits in India can take several years. Interim injunctions and mediation can protect the property and sometimes lead to earlier settlement.
