Buying & Selling Property for clients in Norway

Indians who have settled in Norway often decide to sell a flat in India, while others buy for parents or for a later return. Both can be done from Norway with careful planning.

Buying & Selling Property for clients in Norway
In short

From Norway you can sell or buy Indian property through an attorney holder acting on an apostilled power of attorney. The buyer of your property must deduct TDS at NRI rates on the full price unless you get a lower deduction certificate. Proceeds are paid into your NRO account and can be sent to Norway up to USD 1 million per financial year after Form 15CA and 15CB. NRIs and OCI cardholders may buy residential and commercial property, but not agricultural land, plantations or farmhouses.

Buying & Selling Property from Norway: how it works

For a sale, we check title and mutation records, property tax receipts and any society or builder dues, and review the buyer's draft agreement. Where the actual gain is low, we apply for a lower or nil deduction certificate before completion, which avoids tax being locked up until a refund. Your attorney holder signs and registers the sale deed. We confirm funds have reached your NRO account and help with the remittance to your Norwegian bank account.

For a purchase, we carry out title and approval checks, confirm RERA registration for new projects, and make sure payments come from your NRE or NRO account or by inward remittance from Norway. We review the builder buyer agreement for delay and refund clauses. After registration, we arrange mutation in the municipal or revenue records. Keep transaction documents; Norwegian authorities may ask about the source of funds and the value of the asset for wealth tax purposes.

What clients in Norway should know

  • Norway taxes residents on worldwide capital gains and levies wealth tax, so an Indian property sale or purchase should be discussed with your Norwegian tax adviser too.
  • Norwegian citizens buying as OCI cardholders should note that agricultural land cannot be bought, though it can be inherited.
  • Indian banks may require fresh KYC with your Norwegian address before releasing or remitting sale proceeds.
